The most recent bulletin on the law suit brought by iMEGA – the Interactive Media Entertainment and Gaming Association – in attempting on the legal standing to overturn the Unlawful Internet Gambling Enforcement Act is that a date has been scheduled at the New Jersey United States District Court in Trenton and to be heard before Judge Mary L. Cooper. The iMEGA president Edward Leyden is quoted by the Red Herring publication as stating that the they consider the law breaches the Tenth Amendment's first amendment members' rights. They further consider that the government has over ridden its authorization and wronged its clients in the WTO argument with Antigua. AOL's ex-executive and iMEGA establisher, Joe Brennan Jr. related to the Gambling911, the Internet gaming portal, that the UIGEA may still be legalized before September 4, the date of the case in New Jersey. However, they are sure that this will be avoided from occurring by the judge. The plaintiff iMEGA's lawful case will be brought before the presiding judge and reviewed, together with the reply from the United States Treasury and the United States Department of Justice, namely the defendant. It can then be decided if to concede to the plaintiff's demand for the UIGEA to be restrained in an enforceable manner.
